IRRADIATION OF CHILEAN CIVIL CODE, ESPECIALLY IN VENEZUELA: A DECISIVE FACTOR IN THE CONTINUITY OF ROMAN LAW IN LATIN AMERICA

RESUMEN         

          El Código civil chileno de Andrés Bello constituye uno de los ejemplos codificadores americanos por antonomasia, cuyo ámbito de irradiación puede dibujarse trazando tres círculos concéntricos: el más próximo, de adopción; el segundo, de dependencia; y, finalmente, un tercero, de impacto. En otras palabras, estamos hablando del cuerpo legal que ejerció más influencia en toda América Latina, con una repercusión comparable a la que en su día representó el Code civil francés en el ámbito europeo, hasta el punto de poder atribuirle entre sus excelsas virtudes la de erigirse en factor decisivo para la continuidad de la tradición jurídica romanista en tierras americanas tras la emancipación y fin del periodo colonial. Venezuela es un ejemplo más de tal aserto.

ABSTRACT                

          The Chilean Civil Code of Andres Bello is one of the quintessential American coders examples, the scope of irradiation can be drawn by drawing three concentric circles: the closer, adoption; the second, dependency; and finally a third impact. In other words, we are talking about the legal body that exerted more influence throughout Latin America, with a comparable influence to that once represented the French Civil Code at European level, to the point of being able to attribute among its lofty virtues of establish itself as decisive for the continuation of the civil law on American soil after emancipation and the end of the colonial period factor. Venezuela is an example of such an assertion.
