BRIEF CONSIDERATIONS ABOUT THE JURIDICAL RELEVANCE OF THE CONCEPTION

RESUMEN La importancia atribuida a la concepción por el derecho romano ha sido objeto en los últimos años de una conspicua producción doctrinal. Las contribuciones a la discusión que han sido publicadas, sin embargo, no siempre han conducido a un progreso significativo del estado de la cuestión. En todo caso, es posible afirmar que la orientación del legislador justinianeo en materia de condición jurídica del concebido no se separa de los resultados a los que llegó la elaboración jurisprudencial clásica.
ABSTRACT The importance attributed to the conception by the Roman Law has been object in the last years of a conspicuous doctrinal production. The published contributions to the discussion, however, have not always led to a significant progress of the state of the question. In any event, it is possible to affirm that the Justinian legislator's orientation as regards the legal status of the one conceived doesn't differ from the results to which the classic jurisprudential elaboration has arrived.
